1. Acceptance of Terms

By downloading, installing, or using SnoTel Mapper ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Jason Flaherty ("we," "us," or "our"), the developer and operator of SnoTel Mapper.

2. Description of Service

SnoTel Mapper is a mobile application that provides access to publicly available snow and weather data from various government and public sources, including:

• SNOTEL (Snow Telemetry) station data from USDA NRCS
• Weather forecasts and predictions from NOAA
• Avalanche forecast information from Avalanche.org
• Weather radar and precipitation data
• Webcam feeds from Windy.com (Pro feature)
• Calculated snow predictions and risk indicators (Pro feature)
• Multi-model weather forecasts (Pro feature)

The App is designed to help backcountry enthusiasts, skiers, snowboarders, and winter weather professionals access this information in a convenient format.

Important: All predictions, alerts, and calculated data are provided for informational purposes only and should not replace professional judgment, avalanche training, or consultation with official avalanche forecasters.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use.

You may NOT:

• Modify, reverse engineer, or decompile the App
• Use the App for any commercial purpose without our permission
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App in any way that violates applicable laws or regulations

4. Data Accuracy and Reliability

You acknowledge and agree that:

• Data may be delayed, incomplete, or inaccurate
• Weather stations may malfunction or report incorrect readings
• Avalanche forecasts are opinions and may not reflect actual conditions
• SNOTEL alerts are indicators only, NOT avalanche forecasts
• Snowfall predictions are estimates with inherent uncertainty
• Weather predictions may differ from actual conditions
• Network connectivity may affect data availability
• Cached data may be outdated
• The App should never be your only source of information for backcountry decisions
• Always consult official avalanche centers and multiple authoritative sources before venturing into avalanche terrain

5. Limitation of Liability

IMPORTANT - PLEASE READ CAREFULLY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• We are not responsible for any injuries, damages, or losses resulting from your use of the App
• We are not liable for decisions you make based on information from the App
• Your use of the App for backcountry activities is entirely at your own risk

6. Assumption of Risk

By using this App, you acknowledge that:

• Backcountry winter activities carry inherent risks including serious injury or death
• Avalanche conditions can change rapidly and are unpredictable
• You are solely responsible for your safety and decision-making
• You have proper training, equipment, and experience for your chosen activities
• You will consult multiple sources of information before venturing into the backcountry
• You will check local avalanche forecasts and weather conditions from official sources

7. User Responsibilities

As a user of the App, you agree to:

• Use the App responsibly and in accordance with these Terms
• Not rely solely on the App for life-safety decisions
• Verify critical information from official sources
• Have appropriate avalanche safety training and equipment
• Respect wilderness areas and follow Leave No Trace principles
• Comply with all applicable laws and regulations

8. Pro Subscription

Certain features of the App require a paid subscription ("Pro Subscription"). Pro features include:

• Hourly data measurements
• 7-day NOAA weather forecasts
• Snowfall predictions (24h, 48h, 72h)
• SNOTEL alerts for avalanche risk indicators
• Multi-model weather predictions
• Wind and cloud cover data
• Nearby webcam feeds
• Enhanced caching and priority features

8.1 Subscription Terms

• Subscriptions are managed through Apple App Store or Google Play Store
• Payment is charged to your iTunes Account or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal by going to your Account Settings after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

8.2 Refunds

• All subscription purchases are subject to the refund policies of Apple or Google
• We do not directly process refunds; contact Apple Support or Google Play Support for refund requests
• Subscriptions may be cancelled at any time but are not prorated for partial periods
• Cancelling a subscription prevents future charges but does not refund previous payments

8.3 Changes to Pro Features

• We may add, modify, or remove Pro features at any time
• We reserve the right to change subscription pricing with advance notice
• Existing subscribers will be notified of material changes via the App or email (if provided)
• Price changes for existing subscriptions take effect at the next renewal after notice

8.4 Apple EULA

For iOS users, your use of the App and any Pro Subscriptions are also governed by Apple's Licensed Application End User License Agreement (EULA). You can review Apple's standard EULA at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

9. Third-Party Content and Links

The App displays content from third-party sources and may contain links to external websites or services. We are not responsible for:

• The accuracy or availability of third-party data
• The content or privacy practices of linked websites
• Any issues arising from your use of third-party services

10. Intellectual Property

The App, including its design, code, and original content, is owned by us and protected by copyright and other intellectual property laws. Third-party data sources retain their respective ownership rights.

11. Updates and Changes

We may:

• Update the App to add features, fix bugs, or improve performance
• Modify these Terms at any time
• Discontinue the App or certain features with or without notice

Continued use of the App after changes constitutes acceptance of modified Terms.

12. Termination

We reserve the right to:

• Suspend or terminate your access to the App for violation of these Terms
• Discontinue the App at any time
• Modify or remove features without liability

13. Indemnification

You agree to indemnify and hold harmless the developers, operators, and affiliates of SnoTel Mapper from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of others
• Your backcountry activities or decisions

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Oregon, and you hereby consent to personal jurisdiction and venue therein.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jason Flaherty regarding use of the App.
